SALARY RANGE : $96,600 - $134,310

Base salary is determined by the knowledge, skills and abilities of the applicant.

CLOSING DATE : This position will close on July 20, 2018.

LOCATION : Rapid City, SD


This position will be focused on providing legal counsel and oversight in real estate and land management matters, including but not limited to private and public right-of -way, easements, permits, licenses and other types of land rights and access agreements. The position will support the operation of regulated electric and natural gas business units in various types of real estate, land management, and land dispute matters and will be responsible for ensuring compliance with laws, rules and regulations, and contractual arrangements.

REPORTING RELATIONSHIP : Associate General Counsel


  • Investigate, research, and provide legal advice concerning a broad range of land management and real estate issues, which arise in the company’s day-to-day business activities.

  • Represent company in land disputes, in court, and before county commissions when necessary.

  • Provide management with legal support related to business operations, including contract administration and performance, joint ventures and other strategic partnerships.

  • Provide legal support and assistance to the General Counsel.

  • Provide management with legal support related to acquisition and divestiture of real property.

  • Draft and review legal contracts and documents for compliance with legal requirements and corporate interests.

  • Develop firm understanding of company’s real estate and land management practices, needs and objectives.

  • Review and interpret legislation, rules and regulations governing land rights and land management issues in relevant company jurisdictions and in matters involving state, private, tribal and federal lands (including Bureau of Land Management and the United States Forest Service).

  • Assist in the supervision of outside counsel on legal matters, as necessary.


  • Support and comply with corporate policies, goals and objectives.

  • Participate and represent the company in civic, professional and industry-related activities.

  • Participate in legal department planning, project prioritization and administrative tasks.

  • Perform other tasks as assigned.


  • Maintain professional working relationships with departments across the enterprise.

  • Develop and maintain effective working relationships with all internal and external clients.


  • A minimum of three years of relevant legal experience required.


  • Juris doctor degree from ABA accredited law school is required.


  • Knowledge and understanding of the regulated business environment, including electric utility operations and natural gas utility operations.

  • Knowledge of land issues surrounding oil and gas operations also desirable.

  • Knowledge of general commercial and corporate legal support requirements.


  • Demonstrated ability to distinguish relevant facts, assimilate and analyze facts, and apply legal techniques to resolve complex legal issues.

  • Proficient verbal and written communication skills.

  • Ability to make decisive, sound judgments, taking responsibility for developing plans to achieve optimal legal and business solutions.

  • Licensed to practice law in Colorado, South Dakota, Nebraska or Wyoming.


  • Occasional travel may be necessary to other Company locations.
